Please read the following policies carefully before booking a photography session.
Focal Point Photography, DBA EVERPEAK Visuals, is the photography business responsible for providing the services described on this website.
“EVERPEAK Visuals” is the public-facing business name used by Focal Point Photography. Throughout these policies, the terms “EVERPEAK Visuals,” “we,” “us,” “our,” or “the photographer” refer to Focal Point Photography, DBA EVERPEAK Visuals.
A non-refundable deposit of 50% of the total session cost is required at the time of booking in order to reserve and lock in your session date, time, and location. Your session is not considered booked or confirmed until this deposit has been received.
The deposit reserves your selected time exclusively for you and compensates the photographer for the time, planning, communication, and preparation involved in securing and preparing for your session.
Weather-related circumstances may be handled through rescheduling when the photographer determines that conditions make the session unsafe or impractical.
If you fail to show up for your scheduled session, your deposit is forfeited and will not automatically be transferred to another date or future session.
If the session is completed as scheduled, the 50% deposit is applied toward the total session price.

By booking a photography session with EVERPEAK Visuals, you acknowledge that your booking constitutes an agreement between you and the photographer.
Reserving a session date, time, and location means you are committing to attend the session as scheduled. Failure to attend may result in the loss of your booking and payments already made.
Payment is required before final delivery of photographs. The remaining 50% balance must be paid before or at the beginning of the session unless another arrangement has been approved in writing.
Accepted payment methods may include cash and card payment through the official payment method provided by EVERPEAK Visuals.
Any additional fees, upgrades, additional services, extended session time, location fees, travel fees, additional images, or other agreed-upon charges must be paid in full before final photographs are delivered.
By booking a session, you confirm that you understand and agree to these payment, attendance, and delivery requirements.
EVERPEAK Visuals respects your privacy and makes reasonable efforts to keep information provided by clients private and secure.
EVERPEAK Visuals respects your privacy. Personal information provided to us is treated as private and is used only for legitimate business purposes related to providing photography services, communicating with clients, processing bookings and payments, and maintaining necessary business records.
Depending on how you interact with EVERPEAK Visuals, we may receive information such as:

Information you provide may be used only for purposes reasonably connected to your relationship with EVERPEAK Visuals, including:
We will not sell, rent, or intentionally disclose your personal information to unrelated third parties for their own marketing purposes.
EVERPEAK Visuals is independently operated, and client information is intended to be accessible only to the photographer/founder directly, except when limited access by a third-party service is necessary to operate the business.
For example, booking, website, gallery, communication, or payment providers may process or store information when necessary to provide their services. Those providers may have their own privacy policies and security practices.
We do not give unrelated individuals access to client information for personal use.
Card information may be provided when paying the required 50% deposit and/or the remaining 50% balance.
Card information is used only for the purpose of processing the applicable payment and managing the associated booking.
EVERPEAK Visuals will not use your card information for unrelated purchases, marketing, or any other purpose.
After the booking's required payments have been completed, EVERPEAK Visuals will delete any card information stored within its own accessible business records or systems that is no longer necessary for processing the booking.
Payment processors or financial service providers may retain transaction records, payment confirmations, or other information as required for payment processing, fraud prevention, accounting, legal, or regulatory purposes. EVERPEAK Visuals does not control the retention policies of those third-party providers.
By providing your phone number and requesting or agreeing to communication by text message, you may receive messages related to your photography services.
These messages may include:
EVERPEAK Visuals will not intentionally use your phone number to send unrelated promotional messages that are outside the purpose for which your contact information was provided.
You may stop receiving text messages from EVERPEAK Visuals at any time.
To stop receiving text messages, simply reply:
STOP
After receiving an opt-out request, EVERPEAK Visuals will stop sending further non-essential text messages to that number, except where communication is necessary to complete an existing transaction or as otherwise permitted or required by law.
You may also contact the photographer directly to request that text communication be discontinued.
We make reasonable efforts to keep client information private and secure.
We will not intentionally publish, sell, or publicly disclose your personal contact information, booking details, or private communications except:
No website or electronic system can be guaranteed to be completely secure. While we take reasonable precautions to protect information, we cannot guarantee that unauthorized access, loss, or disclosure will never occur.
Your personal information and your photographs are treated separately.
The photographer may retain copies of photographs for legitimate business purposes, including delivery records, backup, portfolio management, and protection of the photographer's work.
Client photographs will not automatically be publicly displayed solely because you booked a session.
Any promotional or public use of identifiable client photographs will be handled according to the permissions and agreements applicable to that session.
All photographs, images, and visual content created by Focal Point Photography, DBA EVERPEAK Visuals, are protected by applicable copyright laws.
Unless explicitly stated otherwise in writing, all rights to the photographer's original photographs remain with the photographer.
Unauthorized use of photographs may include, but is not limited to:
Permission to use a photograph is not automatically granted simply because the photograph is visible on the website, social media, gallery, or another online platform.
If you are unsure whether a particular use is permitted, contact EVERPEAK Visuals before using the photograph.
By booking a photography session with Focal Point Photography, DBA EVERPEAK Visuals, you agree to the terms and conditions contained in these policies.
Once a photography session has been completed, payments for the completed service are considered final, subject to any rights or remedies that cannot legally be waived.
This includes payments made toward the completed session and any additional services that have already been provided.
EVERPEAK Visuals' creative style, editing process, color grading, retouching, composition, and artistic decisions remain under the photographer's creative control.
RAW photographs are unfinished source files and are not included with photography sessions.
RAW files will not be provided, transferred, or released to clients unless EVERPEAK Visuals specifically agrees otherwise in writing.
Clients receive the final edited photographs selected and finalized for delivery.
By completing a booking or payment, you acknowledge that:
By submitting a booking request, paying a deposit, completing a payment, or otherwise proceeding with a photography session, you acknowledge that you have read, understood, and agreed to the applicable policies above.
